KCF Technologies Privacy Policy

This KCF Privacy Policy addresses the collection, protection, use, and disclosure of information that KCF gathers from users’ access to and use of KCF software on KCF websites and in products including software provided by KCF (collectively, “KCF Software”). KCF may amend this Privacy Policy from time to time by posting an amended Privacy Policy on our website at least thirty (30) days before its effective date. KCF will also notify you via email of any substantial amendments. Your continued use of KCF Software after the effective date of an amended Privacy Policy constitutes your acceptance of the amended Privacy Policy. The information KCF gathers through KCF Software is and will be subject to the Privacy Policy in effect at the time the information is gathered. This Privacy Policy applies only to KCF Software. Submitting your information to us and using KCF Software constitutes consent to the Agreement, which includes this KCF Privacy Policy, the KCF Terms of Sale, all applicable product Terms of Use, and all applicable additional terms and conditions, policies, and statements.

Information KCF Collects

A. Personal and Non-Identifying Information about users

When you participate in using KCF Software as a user within a customer account, we will ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (“Personal Information”), including but not limited to, your name, phone number, email address, business addresses, and any other information that could be used to personally identify you. We collect other information that you provide as part of registration and the administration and personalization of your account with us that does not identify you (“Non-Identifying Information”). Non-Identifying Information includes, but is not limited to, your zip code (on its own), general information about your business and operations, and individual preferences. We may also combine your Personal Information with other information or data. Combined data is treated as Personal Information.

B. Usage Data

KCF Software collects information from devices and other hardware used by or on behalf of you in connection with your access to and use of the KCF Software that we refer to as “Usage Data.” Usage Data includes data collected by such devices and hardware, such as location, time, orientation, vibration, temperature, humidity, device identification, battery level, signal strength, device health, and other environmental and device status data. Usage Data also includes but is not limited to data collected from a device you use when you access KCF Software through a website, mobile application, or other portal or access point, such as the manufacturer and model of your device, browser type, and operating system; referring/exit pages; clickstream data; pages of the KCF websites that you visit; and other statistics. Usage Data includes geolocation data. KCF Software collects geolocation data automatically from certain hardware used with KCF Software and your device.

How KCF Collects Information

KCF may use a number of different techniques and technologies to collect Personal Information, Non-Identifying Information, and Usage Data when you access and use KCF Software.

A. Hardware

The operation of KCF Software is driven principally by the collection of Usage Data from the hardware (including Base Station and Repeaters, Collection Servers, and computers accessing the KCF Software user interface) used by or on behalf of you in connection with your access to and use of the KCF Software.

B. Web Browser & Mobile Applications

Usage Data are collected from the computing or mobile device you use when you access KCF Software through a website using Web browser software or by using a mobile application.

C. Cookies

KCF websites use cookies and other technologies to collect information about how KCF Software is being used. Our websites primarily use cookies to facilitate website content loading and distribution. Our websites only use first-party cookies (i.e., cookies that send data directly to KCF and agents and contractors acting on behalf of KCF). Our websites do not include third-party cookies (i.e., cookies that send data to our contractors for their commercial use), and the cookies on our websites do not track Internet activity across different websites.If you prefer not to enable cookies, you may choose to disable them in your web browser; however, please note that certain features on KCF Software will not be available to you once cookies are disabled.

D. Tracking

Some Web browsers may be configured to send Do Not Track signals to websites, or Internet users may use similar mechanisms, to indicate the user’s preference that certain web technologies not be used to track the user’s online activity. KCF Software does not accept or process such Do Not Track signals or similar mechanisms.

E. Chat & Public Communications

Content added to any chat feature built into KCF Software to enable communications with KCF is segregated and confidential to the account from which it is posted. Please note that the information that you make available can be read, used, and collected by other users who are associated with your account.KCF is not responsible for any aspect of the privacy of any information that you decide to share using a public communication service including any bulletin board, chat room, comment posting feature, or other public communication service, forum, or feature associated with KCF Software or KCF.

Use of User Information by KCF

The user information that KCF collects is used by KCF in order to provide KCF Software to you; to process your transactions; to respond to your inquiries and otherwise communicate with you about your access to and use of KCF Software; to analyze users’ behavior and use of KCF Software; to improve the content and operation of KCF Software; to develop KCF Software and other KCF products and services; and to operate the KCF Software.We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to operate the KCF Software, to facilitate and complete transactions for you, and to correspond with you.We may also use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your account information.To enable core functionality of the KCF Software as an asset monitoring and management system, KCF Software may request your express permission to collect geolocation data from your mobile device if you use a mobile application to access the KCF Software.We may aggregate your information with information collected from other users to attempt to provide you with a better experience, to improve the quality and value of KCF Software, and to analyze and understand how KCF Software is used.You agree that we may collect and use Usage Data, including technical information about your device, system and application software, and peripherals, in order to facilitate the provision of KCF Software to you, including to provide software updates, product support, and other services related to your use of the websites and mobile applications to access KCF Software.

Sharing of Information with Third Parties

KCFs policy is not to share the Personal Information it collects from users with third parties other than as specified below, or where a user expressly consents to our sharing of Personal Information with a third party. We may share user Personal Information with third parties under the following circumstances:

A. Operation of KCF Software

Depending on how KCF Software is used by or implemented for a particular user, KCF Software permits a user to share Personal Information with other users within a customer account. For example, the names of the users can be viewed by other users who share the same account, but not to other users in a different account or other third parties.

B. Business Partners and Vendors

We may provide user Personal Information to our business partners and vendors in connection with providing KCF Software. For example, we may provide Personal Information to business partners and vendors in order to provide KCF Software or portions of KCF Software on our behalf to perform related services, including without limitation, maintenance services, database management, and improvement of KCF Software features or functionality.

C. Business Transfers

As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, sale of assets, or bankruptcy. In the event that KCF itself or substantially all of KCF’s assets are acquired, Personal Information about our users may be one of the transferred assets.

D. Compliance with Law & Protection of KCF & Others

We may release user Personal Information when we believe, in our sole discretion, that release is appropriate to comply with the law, including but not limited to, in response to a subpoena served on KCF; to enforce or apply the Agreement, including the Terms of Sale, applicable product terms of use, and and other agreements, rules, and policies applicable to a user; to protect the rights, property, or safety of KCF, our users, or others; and to prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable.

E. Sharing of Aggregate or Anonymized Data with Third Parties

We may disclose aggregate or anonymized user information (i.e., information that does not include Personal Information identifiable to a specific user) to third parties for our legitimate business purposes, including to improve the content and operation of KCF Software, to develop KCF Software and other KCF products and services, and for marketing and promotional purposes.

International Transfer

KCF controls and operates the KCF Software from its offices in the United States of America. If you access KCF Software from outside the United States, you acknowledge and agree that your information may be transferred to and maintained on computers located outside of your governmental jurisdiction and operated only according to United States law and our Privacy Policy.

Security

We employ administrative, physical, and electronic measures designed to protect your Personal Information from unauthorized access. We do not guarantee the security of our databases, nor that information you supply won’t be intercepted while being transmitted to us over the Internet or other network. Any information you transmit to KCF, you do at your own risk.

Children’s Privacy

KCF Software is not intended for use by children, and any access to or use of KCF Software by anyone under the age of thirteen (13) is unauthorized by KCF.
